what was the final verdict? I am having the same problem with my 04 with 35,000 and the dealer says there is nothing wrong with it as far as they are concerned. Any insight would be great.

All right, the car is back in my care and it runs great now. Wait till I tell you about it.
It turns out with the purchase I had a remote starter installed (by a second company that does most of the additions for this dealership). The problem turned out to be the remote starter. The wires had melted and it wasn't grounded/ insulated right causing the #1 injector problem and also diagnosed in the first visit was a code about not recognizing the key (probably the remote starter malfunction from the get go).
They repaired the wires and checked the fuel injector as well as changed the oil. She runs like a dream now.
And yes, I had read about the lemon law and it was 4 returns for repairs on the same thing in two years of purchase or 18,000 miles in New York state. And no, this wouldn't have counted towards it because it was an aftermarket addition (can you believe it!).
